I.- Legal information and acceptance.
These conditions govern the use of all services provided via the Internet site http://www.medgroup.es/ (hereinafter, the “Web Site”) that the company Medgroup Inversiones, S.L., Sociedad Unipersonal and companies within the group (hereinafter, Medgroup) make available to Internet users. Using the web site confers the status of Site User (hereinafter User) and implies acceptance of all the conditions contained herein. Merely by using the Web Site, the User expresses full acceptance, without reservation of the said conditions, which may be modified by Medgroup at any time. Users are also subject to all specific conditions, notices or regulations governing use that are made known regarding specific content or services that serve as a complement to these General Conditions in so far as these do not contradict them.

II.- Waiver of liability for the functionality of the Web Site and its services.
Medgroup provides no warranty as to the availability and continued functionality of the Web Site, its services and content. In so far as is reasonably possible, Medgroup will provide prior notice of any interruption to the functioning of the aforementioned. In any case, in so far as the law provides, Medgroup accepts no liability for any loss or damage of any nature that may arise from the lack of availability or continuity of the Web Site or any of its services, or for any fault relating to the accessibility of the different web pages within the Web Site or those that provide certain services.

III.- Possible alteration to information available on the Web Site.
All information and documentation included in this Web Site regarding developments or real estate may be subject to change or updates required either officially by the competent authorities or due to the technical development of the projects and their execution. Medgroup will do its utmost to avoid the existence of errors in the information provided on the Web Site, while assuming no liability whatsoever for any loss or damage that the existence, if applicable, of any such error may cause Users.

Medgroup may modify the content of this Web Site at any time without prior notice and is exempt from any responsibility that may derive from such change.

IV.- Use of the Web Site and services by Users.
The User undertakes to use the Web Site, its services and content in a manner that is legal and in good faith, accepting sole responsibility for the use made of the said Web Site, services and content. Unless prior express authorisation has been obtained from Medgroup, the user shall not obtain or attempt to obtain content of any type, be it text, graphics, illustrations, sound files, images or photography, video, software or databases and, in general, any type of material available through the Web Site or its services, using any means other than those provided for that purpose or those normally used to that end on the Internet. The User shall be liable to Medgroup or third parties for any loss or damage that may arise as a result of non-fulfilment of the said obligation. The use of the Web Site with the intention of harming Medgroup property or interests or those of third parties or its use in any other way which overloads, harms or renders useless Medgroup or third party networks, servers or other IT equipment (hardware) or products and IT applications (software), is expressly prohibited.

V.- Waiver of liability for services provided by third parties.
The Web Site provides Users with devices and tools, be they links, directories or search tools, which allow access to web pages or sites that are managed by third parties. Medgroup does not own these third party sites, nor does it promote or offer the content and services contained therein; as such it assumes no direct or subsidiary responsibility for these web pages or sites.

VI.- Intellectual and Industrial Property.
All content, names, logos, brands and databases accessible on the Web Site are subject to industrial and intellectual property rights belonging to Medgroup or the third party owners of said content. Under no circumstances does access to the Web Site or pages therein imply any form of waiver, transmission or cession, either total or partial, of the aforementioned rights, nor does it confer any rights to usage, alteration, commercial use, reproduction, distribution or public communication of the content or intellectual property without express prior authorisation granted specifically to that effect by Medgroup or the third party owner of said rights, except the right to view and make copies for the personal, private and exclusive use of the User, which should always be done in accordance with the principles of good faith and applicable legislation.

VII.- Data Protection.
Through this Legal Notice and in accordance with Organic Law 15⁄1999, dated 13 December regarding the Protection of Data of a Personal Natural, Medgroup hereby informs Users of its data protection policy, so that said Users may decide of their own accord whether they wish to supply the personal details that may be required to subscribe or register for certain services offered. Except where indicated to the contrary, answers to questions regarding personal details are optional. Personal details obtained in this way will be handled in secrecy and strict confidentiality for the purposes of managing and providing the services offered by Medgroup on its Web Site at any given time. The User accepts that the personal details that he/she provides may be processed in computer files belonging to Medgroup and other group companies.

VIII.- Cookies.
From time to time we may use technology known as "cookies" for the purposes of providing content or services in a personalised manner. A “cookie” is a small data file that a Web Site may send to the User’s web browser. The "cookie" may be stored on the hard drive of the User’s computer enabling us to recognise the User when returning to our Web Site. IX.- Applicable law and jurisdiction.
This Legal Notice is governed to all intents and purposes by Spanish Law. All disputes or claims arising from the interpretation or implementation of this Legal Notice shall be subject to the jurisdiction of the Courts of Barcelona.
